The amendment of the Law on Public Procurement of the Republic of Lithuania is being drafted currently. The working group has the intention to set a new possibility for contracting authority to verify the suitability of economic operator.

According to this amendment, the contracting authority would be allowed to require only declaration where an economic operator states, that his personal situation, suitability to pursue the professional activity, status of economic and financial standing, technical and/or professional abilities satisfies the requirements of contracting authority.

The contracting authority would check the suitability of economic operators considering the information declared, rank the tenders and set the preliminary ranking of tenders according the most economically advantageous or lowest price tender.

Then the contracting authority would ask the tenderer who submitted the most economically advantageous or lowest price tender for sufficient evidences to prove the information declared. In case this tenderer doesn’t provide required evidences, contracting authority would ask the second tenderer in the preliminary ranking of tenders to prove the information he declared.

The questions are:

- Does the situation mentioned above complies with the EU directives 2004/17/EC and 2004/18/EC;

- Do other member countries applies the practice mentioned above.

In Belgium is it so ... I think also for Europe ...
